Anyone who registers a domain and operates a website should inform himself extensively about the legal situation. Areas of law, such as trademark law or the law on names, restrict the use of certain domain names.

In order to avoid legal disputes from the outset, one should refrain from registering company names, such as "Allianz", brand names, such as "Aspirin" or city names, and limit oneself to generic terms.


Generic terms

The term generic is used when a thing or something represents a whole class of concepts. Generic terms are therefore in great demand in connection with the registration of a domain. So it is easy understandable that a there is great demand for generic domain names and many people are interested in them. It is therefore not uncommon for legal disputes to arise in the race for a generic domain name.

The Federal Court of Justice in Germany has delivered a clear ruling in this context. The registration of domain names which are at also generic terms is in principle not conflicting with law. This also applies even if the generic term affects naming rights in addition to the generic name.
